Aazma is operated by Kanya Creation, a sole proprietorship registered in Ahmedabad, Gujarat, India ("Aazma," "we," "us"). This Privacy Policy is published under the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Information Technology Act, 2000.
Your personal data, including face images, is stored on AWS Mumbai (ap-south-1) and does not leave India. FASHN.ai processes images in transit; processing logs are retained outside India per their privacy policy but the images themselves are deleted after rendering.
We follow Reasonable Security Practices and Procedures under IT Act s.43A: TLS 1.3 for all API calls, HMAC-signed payment webhooks, encrypted SQLite database backups, role-based access control on AWS. We do not share, sell, or expose your selfie to any third party, ad network, or AI training set.
You must be at least 18 years old to use Aazma. If you are under 18, you must use Aazma only with the express consent of a parent or legal guardian, and that adult is treated as the account holder under the DPDP Act.
By uploading a photo, you grant Aazma a limited, royalty-free, non-exclusive licence to process that image solely to deliver the try-on service. This licence ends when the render is complete or when you delete the source photo, whichever is earlier.
You own the renders Aazma generates for you. We retain a right to use anonymised, low-resolution thumbnails of rendered outputs for service-quality improvement and AI model audit — never for marketing without your separate written consent.
Aazma's rendering depends on FASHN.ai. If FASHN suffers downtime, your render queue is paused; pending credits are not consumed. We do not guarantee identical output for repeat renders — AI is probabilistic by nature.
Aazma's total liability for any claim is limited to the amount you paid us in the preceding 90 days. We are not liable for indirect, incidental, or consequential damages.
These Terms are governed by Indian law. Exclusive jurisdiction lies with courts in Ahmedabad, Gujarat.
Each successful AI render consumes one (1) credit from your account at the moment our processing engine begins generating your image. A credit is "used" when generation starts, regardless of whether you save, download, or like the final image.
Used credits are non-refundable. Aazma incurs an irreversible third-party compute cost the moment a render is generated, and we cannot recover that cost. This is the industry standard followed by FASHN.ai, OpenAI, and similar AI compute platforms.
Unused credits remaining in your wallet are refundable within seven (7) calendar days of purchase if you have not consumed any credit from that specific purchase, less applicable payment gateway fees (~3%). After 7 days, unused credits remain valid for 12 months but are non-refundable in cash.
If a render fails due to a verified technical fault on Aazma's side (not due to poor input image quality, unsupported garment, or breach of our Content Policy), the credit will be automatically restored to your wallet within 24 hours. This is your sole and exclusive remedy for failed renders.
You may cancel any monthly subscription at any time from the in-app Settings. Cancellation takes effect at the end of the current billing cycle; no further charges are made. We send a payment reminder 24 hours before each auto-debit per RBI recurring-payments guidelines.
Nothing in this Refund Policy limits your statutory rights under the Consumer Protection Act, 2019 in case of a "deficiency in service" as defined under section 2(11) of that Act.
Before every upload, you must confirm that you are the person in the selfie AND you own or have explicit consent for every face and every garment photo you upload. Aazma displays a click-wrap consent on each upload screen; checking it is a legal representation under contract law.
Uploading another person's face — partner, mother-in-law, friend, model, celebrity — without their explicit written consent is prohibited and may constitute an offence under IT Act s.66E (privacy violation) and Bharatiya Nyaya Sanhita 2023 ss.336 / 356 (forgery / defamation).
Every rendered output carries a visible "AAZMA" watermark indicating it is AI-generated. Per the MeitY Advisory of March 2024 on synthetic media, removing or obscuring this watermark for redistribution is a breach of these Terms.
No uploads of any person under 18 are permitted in any context. Aazma uses an age-estimation check on every selfie upload.
If you believe a render of you was generated without your consent, report it to our Grievance Officer (Section 5). We will remove the disputed render within 24 hours of receiving a valid complaint, per Rule 3(2)(b) of the IT (Intermediary Guidelines) Rules 2021.
